I have a small wedding venue. We only work 6 months a year, and maybe about 10 weddings are everything. It`s outside. The ceremony takes place in a pasture, and I allow people to go directly to their homes if necessary. Ultimately, it depends on the situation. For example, there have been cases where people with disabilities have suffered injuries and have been rewarded with millions of dollars in punitive damages. Even complaints filed against companies for non-compliance with the ADA have forced companies to pay tens of thousands of dollars. It`s no surprise to learn that many businesses affected by ADA-related lawsuits have been forced to close. To achieve the ADA`s goals, the law has set requirements for businesses of all sizes. These requirements came into force on 26 January 1992. Businesses that serve the public must change policies and practices that discriminate against persons with disabilities; comply with accessible design standards when constructing or modifying facilities; removal of barriers in existing facilities where they are readily available; and provide tools and services as needed to ensure effective communication with people with hearing, vision or speech disabilities. All businesses, even those that do not serve the public, must comply with accessible design standards when constructing or modifying facilities.
“Reasonable” also applies to feasibility. A small business with limited resources may not be expected to make as many ADA accommodations as a large company, although it is a good idea to be as compliant as possible. To help with housing, some businesses may be eligible for free community services and other financing options such as government programs or tax deductions. Title I refers to qualified employers and obliges qualified enterprises to offer persons with disabilities an equal opportunity to take advantage of the full range of employment opportunities available to others. Jen, I wouldn`t believe you`ve gone through the whole process of approving a wedding venue without an accessible bathroom. If you have not made any changes to this barn to be able to hold weddings, there is no legal reason why you need to provide a NEW bathroom that meets the requirements. While you may not have to have one if you have the general public on your site, being able to reasonably accommodate all people is truly a moral choice. I suggest you provide an ADA bathroom. Why not find a creative solution that could be a positive outcome for both parties? Have there been any considerations to consider when using technology to allow your friend to participate remotely, such as a webinar, Skype or simply using your phone to film and share games with your friend?
