The purpose of such a novelty was to give foreign investors the opportunity to seek advice from lawyers of their own state in Ukraine. From a strategic point of view, this should encourage foreign companies to launch projects in Ukraine, as these companies have benefited from better legal defense opportunities. In the event of disqualification from exercising the right to exercise the right to exercise the right to exercise the right as a disciplinary sanction, the lawyer is not excluded for life. After two years, the lawyer can again pass the qualifying examinations and practice as a lawyer again. Lawyers can work in individual law firms, law firms or bar associations in Ukraine. Lawyers may work individually, in law firms or in other forms of organization. The adaptation of the main European standards of independence and self-governance of interest representation in national law paved the way for the integration of the Ukrainian Bar Association into the European professional community, or even the conclusion of a comprehensive association agreement between the EU and Ukraine, which took place only 2 years after the creation of UNBA. The current Law on the Bar Association implements European standards by offering foreign lawyers the opportunity to practice in Ukraine. A lawyer does not need a licence to practise medicine, except for lawyers, who must be admitted to practise. To become a lawyer, a person must have a law degree, have at least two years of legal experience, pass a qualifying examination, complete a six-month internship with a practicing lawyer, take an oath and be registered in the register of the Bar of Ukraine.

Admission is without notice, but may be revoked or suspended in certain circumstances in accordance with the law. It is not necessary for a foreign lawyer to be admitted as a foreign legal adviser in Ukraine, taking into account the fact that practice outside the areas reserved for lawyers is not regulated. The Advocacy Act stipulates that Ukrainian citizens and foreigners may become lawyers. Foreigners who have been admitted to the Bar Association abroad must apply for admission to the Register of the Bar Association of Ukraine in order to practise as a lawyer. Ukrainian and foreign citizens may practice as lawyers. Learn more about our work in Ukraine so far. To date, our work has focused on a wide range of legal reforms, anti-corruption and legal education activities. For 9 years, we have been convinced that the Ukrainian Law “On Bar Association and the Practice of Law” embodies European standards of legal independence and provides the legal community with effective tools to build an autonomous organization capable of ensuring a high level of professional standards and ensuring the protection of professional rights and guarantees of lawyers. It is not necessary for foreign law firms to acquire special licenses to exercise this right beyond the usual registration procedures (or the establishment of a representative office). Can a foreign lawyer be admitted to practice and practice as a foreign legal advisor, and what is the scope of this limited licence? Even if a foreign law firm does not need a legal license, does it need to register in any form to open an office? (e.g.

with a Ministry of Corporate Affairs, etc.) The current Law on the Bar Association has changed the old concept: the powers of the Bar Association are not delegated by the State, as in previous years; Instead, the Bar derives its powers directly from the Constitution and the law, such as autonomy, managing access to the legal profession, resolving issues of disciplinary liability of lawyers, maintaining the unified register of lawyers of Ukraine, etc. Has it made any commitments under the GATS in the area of legal services? ABA ROLI has been working to promote human rights and the rule of law in Ukraine since 1992, focusing in particular on the fight against corruption, trafficking in human beings, the development of cash and cybercrime. Together with Ukrainian stakeholders, we worked on drafting and analyzing laws, creating a unified bar association, and supporting the establishment of a legal aid system. These efforts continue today with funding from the U.S. State Department`s Office of Democracy, Human Rights, and Labor (DRL). Ukraine`s only trade agreement covering services is the EFTA agreement, which reaffirms Ukraine`s full commitments in the area of legal services under the GATS. The creation of UNBA fulfilled one of the conditions for the future conclusion of the Association Agreement, namely the creation of a professional bar and the legal protection of the status of the legal profession. We have made every effort to develop it, because we have understood that the self-management of the profession, based on European best practices, ensures that it advocates its independence and a high level of professional standards. The national inquiry showed support for the current model of advocacy and a high appreciation of the quality of services provided by lawyers locally and nationally. ABA ROLI aims to strengthen national unity, promote civic identity and promote informed and constructive dialogue on issues central to the country`s European future. We bring together media, civil society and young actors from different regions of Ukraine to work on joint projects focused on strengthening social cohesion in Ukraine, defined as tolerance for differences between groups and their unity in terms of democratic principles and reforms.
